LEGO Toyworld Australia Consumer Promotion 2024

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  1. The Promoter is LEGO AUSTRALIA PTY LTD (ABN 42 001 540 914) of Level 3, 5 Blue Street North Sydney, NSW 2060, telephone: +61 429 661 878.
  1. Entry is only open to Australian residents.  Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion.
  1. Employees (and their immediate families) of the Promoter, Toyworld and agencies associated with this promotion are ineligible to enter. “Immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  1. Promotion commences at 9:00AM on Saturday 03/02/2024 and closes at 11:59pm on Sunday 14/04/2024 AEST on (“Promotional Period”). Any entries received after this period shall not be valid.
  1. To be eligible to enter, individuals must spend $100 or more in a single transaction on LEGO products from any participating Australian Toyworld store nationally during the Promotional Period (“Qualifying Transaction”).
  1. A participating Toyworld store, is any Toyworld store nationally that displays promotional material featuring this promotion including the Toyworld Australia online store. Alternatively, a list of participating Toyworld stores can be found at: https://www.toyworld.com.au/pages/win-with-toyworld.
  1. To enter, individuals must then visit www.winwithToyworld.com.au follow the prompts to the promotion entry page, input the requested details (including their full name, state, email address, phone number, date of birth, any LEGO CITY, LEGO FRIENDS and or LEGO DREAMZzz set purchases, the Toyworld store where the Qualifying Transaction was made), upload a copy of the purchase receipt for the Qualifying Transaction and submit the fully completed entry form so it is received during the Promotional Period.  For any transactions that contain any LEGO CITY, LEGO FRIENDS or LEGO DREAMZzz sets, entrants will be eligible for an additional entry per theme into the draw per Qualifying Transaction. Additional entries will be applied once the entrant has completed the field in the entry form to confirm they have purchased an eligible LEGO CITY, LEGO FRIENDS and/or LEGO DREAMZzz set as part of the transaction. Where several of the aforementioned sets are purchased within the same theme, only one additional entry will be given.  Where several themes are purchased, there is a Maximum of 4 entries into the draw for any one Qualifying Transaction, i.e. one entry for the $100 spend and maximum 3 bonus entries for the purchase of three different theme sets.

    To provide an example: where an entrant spends $100 on one LEGO CITY set and one LEGO FRIENDS set, three entries will be given – one for the Qualifying Transaction and one for each theme.  Where an entrant spends $100 on two LEGO CITY sets, two entries will be given - one for the Qualifying Transaction and one for each theme.  
  1. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per Qualifying Transaction (regardless of the number of LEGO sets purchased in that transaction), except where LEGO CITY, LEGO FRIENDS or LEGO DREAMZzz sets are purchased, in which case the maximum entries per Qualifying Transaction is as set out in clause 8; and (b) each entry must be submitted separately and in accordance with entry requirements. 
  1. Entrants must retain their original Toyworld purchase receipt for their entry as proof of purchase. Failure to produce the proof of purchase for an entry when requested may, in the absolute discretion of the Promoter, result in invalidation of an entrant’s entry and forfeiture of any right to a prize. Purchase receipt must clearly specify the store of purchase, that a LEGO set was purchased and that the purchase was made during the Promotional Period but prior to entry.
  1. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  1. Incomplete or indecipherable entries will be deemed invalid.
  1. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  1. There will be five (5) minor prize draws and one (1) major prize draw conducted for all entries received during the Promotional Period. The draw will be administered via randomised electronic draw, managed by the Promoter’s fulfilment partner, Greeneagle Distribution & Fulfilment, and will take place at 5/9 Fitzpatrick Street, Revesby NSW 2212 on 06/05/2024 at 4pm AEST. The winner will be notified by email and telephone within two (2) business days of the draw and be informed on how to claim their prize. Their name will also be published online at www.winwithToyworld.com.au from 13/05/2024. The Promoter shall have no liability for the winner’s failure to receive notices due to spam, junk e-mail or other security settings or for the winner’s provision of incorrect or otherwise non-functioning contact information.
  1. The Promoter’s decision is final and no correspondence will be entered into.
  1. The first valid entry drawn will win the Major Prize described in Clause 17 and the subsequent valid five (5) entries drawn thereafter will each win a Minor Prize  described in Clause 21.  
  1. The Major Prize includes;
    • Two (2) adults and two (2) children (11 years or under) x return economy airfares from winner's nearest capital city to Singapore;
    • Five (5) nights’ accommodation at the 4-star LEGOLAND Malaysia Resort with breakfast included;
    • 5-day passes to LEGOLAND for two (2) adults and two (2) children (11 years or under);
    • Airport transfer to and from the airport and resort; and
    • AU$1,000 spending money to be spent during the Major Prize trip, to be provided to the winner in the form of a pre-paid VISA debit card.
  1. The Major Prize includes only the items set out in Clause 17 and does not include costs relating to additional spending money, additional meals, taxes (excluding airline and airport taxes), insurance, passports, visas, vaccinations, transport to and from departure point, additional transfers, items of a personal nature, in-room charges and all other ancillary costs or upgrades (including airline fares). The Major Prize must be booked by 29 November 2024 with travel dates permitted up until 30 November 2025 and is subject to booking, flight and accommodation availability. Major Prize cannot be taken during the month of December.
  1. The winner and their companions are responsible for ensuring that they have valid passports (for at least 6 months on date of travel with at least one blank visa page), and any requisite visas, vaccinations and travel documentation. The winner and their companions must depart from and return to the same departure point and travel together. Frequent flyer points may not be awarded as part of the Major Prize. Major Prize is subject to the standard terms and conditions of individual prize and service providers. The winner may be required to present their credit card at time of accommodation check in.  Once tickets have been issued, they are valid for the flights and dates shown, and if a booking is cancelled, no alternative tickets will be issued.  The prize will be forfeited if the winner and/or their travel companions do not have the necessary documentation on the date of travel, or are otherwise denied travel.  Travel insurance is not included in the prize but is mandatory.  Any specific visa or health declaration (including but not limited to COVID 19 vaccinations) necessary for travel is the responsibility of the winner and their travel companions.
  1. In the event that circumstances beyond its reasonable control prevent the Promoter from fulfilling its obligations under this Agreement, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify the Major Prize.  Such circumstances shall include, but shall not be limited to, war, terrorism, state of emergency (including public health concerns, communicable disease or mass illness outbreak or pandemic),  or disaster.
  1. The five (5) valid and correct entries drawn after the Major Prize Draw is entitled to each win a Minor Prize of up to AU$200 RRP worth of LEGO building sets (valued using the Regular Retail Price for each set before any discounts or offers are applied) as selected by the Promoter. The Promoter’s selection of LEGO sets forming the prize pack is final. 
  1. If for any reason the winner does not take / redeem the prize at/by the time stipulated by the Promoter, then the prize will be forfeited and re-awarded in line with clause 26.
  1. If the prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
  1. Total prize pool value will vary depending on travel dates, but (based on the Major Prize being taken as set out in these Terms and Conditions) is no more than AU$16,000.
  1. The prizes (or any unused portion of the prize) are as stated and are  not transferable, changeable or exchangeable and cannot be taken as cash.  In the event that the winner of the Major Prize wishes to travel with a party smaller than two adults and two children, the unclaimed aspects of the Major Prize will be forfeited.
  1. The Promoter may draw additional reserve entries on the date set out in clause 14 and record the results of the additional draw in case an invalid entry or ineligible entrant is drawn.  In the event that a winner does not claim their prize within 3 months of being notified, the relevant prize will be awarded to the next person drawn and recorded.  The replacement winner will be notified by email and telephone within two (2) business days of the original 3 month claim period expiring.   Their name will be published online at www.winwithToyworld.com.au from 15/08/2024.
  1. The Promoter may ask the winners to provide a photograph or other content of them enjoying the Major Prize or Minor Prize. Where this is the case, entrants consent to the Promoter using their name likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including announcing the outcome of the promotion), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  1. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  1. Any cost (such as data roaming costs) associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
  1. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  1. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.  By entering this promotion and/or accepting the prize, entrants accept any risk for themselves and for their companions, associated with travelling or otherwise enjoying the Major Prize.  To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever (including but not limited to direct, indirect, special or consequential loss or damage, lost revenue or profit) or personal injury suffered or sustained in connection with any travel, or from accepting or using any prize. Nothing will exclude the Promoter’s liability for injury or loss suffered which cannot be excluded by law.
  1. Entrants acknowledge and agree that the Promoter may collect their personal information ("PI") in order to conduct the promotion (including announcing the outcome of the promotion) and may, for this purpose, disclose such PI to third parties, including but not limited to Toyworld, agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI and consenting to the Promoter using this PI for the purposes set out in this clause. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.lego.com/en-au/legal/legal-notice/privacy-policy-full.  In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for any purposes  which the user specifically consents to during the promotion entry process, which may include promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. The Promoter will not disclose PI to any entity outside of Australia.
  1. Except where prohibited by law, all issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions shall be governed by, and construed in accordance with, the laws of New South Wales, Australia. All participants consent to the jurisdiction of the courts of New South Wales, Australia.
